Gary Miller helps launch Reclaim American Jobs Caucus

Today on Capitol Hill, Members of Congress announced a new caucus that will focus on putting millions of Americans back to work. Currently, 15 million Americans are unemployed, while an estimated 8 million illegal immigrants are employed.
The Reclaim American Jobs Caucus is a 40 Member, bipartisan caucus, headed by Reps. Lamar Smith, Sue Myrick, and Gary Miller. As the national unemployment rate stubbornly hovers around 10 percent, the caucus will work to highlight the link between illegal immigration and record unemployment in the United States.
“If the immigration laws we have on the books were enforced, we could cut unemployment in half,” Rep. Smith said. “American citizens and legal immigrants should not have to compete for jobs with those here illegally.”
“We need to turn off the employment magnet that draws undocumented workers,” Rep. Myrick said. “By encouraging employers to use E-Verify and increasing worksite enforcement, we make sure that Americans and legal immigrants are able to get back to work.”
“At home in California, almost weekly I hear from my constituents that illegal immigration is exacerbating the unemployment crisis and the facts validate their concerns,” Rep. Playing Politics With the IRS Problem Solver: California's Democratic Secretary of State Deborah Bowen Rejects Congressional Candidate Phil Liberatore's Ballot Identification
WHITTIER, Calif., March 18 /PRNewswire/ -- California's top elected Democrat, Secretary of State Deborah Bowen, has rejected Republican Congressional candidate Phil Liberatore's ballot designation, alleging that Liberatore's description as "IRS Problem Solver," is broad and associated with an entity or organization. California Republican Assembly Endorses Hagman and Miller
Of the endorsements currently reported, the CRA endorsed in nine Congressional races, two state Senate races and twelve Assembly races. I noticed that they endorsed challenger Clay Thibodeau instead of Congresswoman Mary Bono Mack.
Endorsement by the CRA requires a two-thirds vote of the members/delegates voting.
They did make local endorsements in Orange County so check out the list if you are an OC resident.

IV Daily Bulletin gets it wrong, SGV Tribune and Whittier Daily News get it right
In reporting about the 60th Assembly District they report that Curt Hagman is unopposed. However, yesterday Democrat Gregg Fritchle filed his papers in Los Angeles County.
In their coverage of the 42nd Congressional race they only mention that David Su and Lee McGroarty are challenging Rep. Gary Miller for the Republican nomination, forgetting about Phil Liberatore who filed in Los Angeles County. They also fail to mention that Democrat Michael Williamson and Libertarian Mark Lambert are on the ballot.
Maybe the reporter didn't realize that a legislative district can include more than one county and only looked at San Bernardino county filings. The San Gabriel Valley Tribune and Whittier Daily News, owned by the same company as the Daily Bulletin, didn't make the same mistake when reporting about the races. Both mention Fritchle in the 60th and report about all candidates in the 42nd.
In January, the Daily Bulletin published a similar story that failed to mention candidates in the 42nd race and 32nd State Senate race. Maybe the newspapers need to share notes so the Daily Bulletin doesn't make this mistake for a third time in a row on the next story.

Norby will be facing Green Party candidate Jane Rands who officially qualified for the ballot today.
Norby may be facing a Democratic challenger, but we will have to wait until Monday to find out. Democrat Esiquio Ramos Uballe returned the paper work today but has not officially qualified for the ballot yet. This probably means that the signatures on the nomination form still have to be verified.
Update (March 17): Democrat Esiquio Ramos Uballe has qualified for the ballot.

Lee McGroarty Racks Up Another Endorsement
It looks like this group isn't really an organization at all, rather a loose confederation of people with similar ideological views. So what the value there is in this endorsement is unknown. I would be interested to know if Miller sought their endorsement and my bet would be that he has never heard of them. That being said, it looks like Lee is out there and making a real go of it.The Independence Caucus operates as an "open-source" organization.

Interesting Comment: A 42nd Challenger with Baggage?
The author does not specifically name the candidate, or candidates, that the three questions (which I highlighted) apply to. It could be a primary and/or general election challenger(s) the author is referencing.
Rep. Gary Miller is being challenged in the Republican primary of the 42nd district by Phil Liberatore, Lee McGroarty and David Su. Michael Williamson and Louie Contreras are seeking the Democratic nomination. Mark Lambert is seeking the Libertarian nomination.

Now that I am retired, I have extra time to research candidates and look carefully at what they are saying and more importantly what is being said about them. With filing nearing a close, I see that the challengers in the 42nd Congressional District are rehashing 4 year old newspaper allegations against Congressman Gary Miller.
Whatever happened to these allegations? I cannot find any public record of any criminal or legal action that stemmed from them. Why in four years has nothing happened? Most likely because the allegations were sensationalized hype churned by overzealous reporters trying to be the next Woodward or Bernstein.
Why are we hearing these same old, unproven stories again?
Do Congressman Miller’s challengers really think that anyone will vote for them simply because they throw rocks and stir up mud?
If I was advising Congressman Miller, and I am not, the first thing that I would do is take a peek at the available public records on these rock-throwing challengers. Some of the questions that I would look into are:
· How many prior elections did these people actually vote in? (Available at the Registrar of Voters)
· How many times were they and their businesses sued? (Available on-line from various background search engines)
· Were they ever subject to disciplinary action or lose a professional license? (Available from the State of California)
Before these kids start yelling how much the room smells, they should check their own diapers and see how full they really are. I’ve taken the time to do a preliminary look into these candidates and I’ve seen what a mess their diapers really are.
For the next few months, I’m going to sit back and watch these children throw rocks at the Congressman and wait. I’ll wait for the Congressman to get tired of this silliness and pick up a few thousand pound boulders and toss them back.
Not only are these challengers backgrounds so littered with dubious behavior, Congressman Miller has a huge campaign warchest to let every voter in the district know everything about his opponents.
Now it’s time to sit back and watch this election unfold.

James Gerbus out of 72nd race? Su out of 42nd race?
There were two candidates in the Three Corners Region that did not return their forms by Thursday. This is a good indication of who may be getting out of a race.
James Gerbus was issued SIL forms for the 72nd Assembly Republican primary on January 8, the first week the forms were available, but never returned them. He was also issued SIL's during the Special Election in which Chris Norby won the Republican nomination, but didn't return those either. So it wouldn't be surprising if he has decided once again not to run for the Assembly. Gerbus, so far, is the only Republican to give any indication of a run against Norby for the Republican nomination. He has not filed any campaign finance paperwork with the California Secretary of State or created a campaign web site.
David Su was issued SIL forms for the 42nd Congressional Republican primary on January 8, but didn't return them. Su has made appearance's at the City Council meetings of Diamond Bar and Chino Hills stating that he was thinking about running against Rep. Gary Miller in the Republican primary. He has not filed any campaign paperwork with the FEC or set up a campaign web site.
Only time will tell if these candidates are in or out, but chances are that they are out.

Torres has not yet pulled nomination papers but she is expected to seek re-election. Her most recent campaign finance reports showed Torres had about $150,000 cash on hand. If able to raise funds Moors could be a very competitive challenger for Torres.

A Ban on a College Tuition Break for Illegal Immigrants?
The Daily Bulletin has another article on another piece of pending legislation in Congress dealing with illegal immigration. The bill, supported by Rep. Buck McKeon and Gary Miller, would ban illegal immigrants from receiving in-state college tuition. California allows illegal immigrants to receive in-state tuition.
Rep. Miller told the Daily Bulletin,"You're telling me somebody who is an American citizen, was born here and parents pay taxes has to pay more than somebody here illegally. That's not right. We have a shortage of space for many students and you have limited dollars. With the dollars available, they should first be applied to people that are legally in this country and are citizens."
As I did for yesterday's post I will list the position of the other candidates for the 42nd Congressional race.
Rep. Gary Miller opposes in-state tuition for illegals, as is noted above.
David Su does not have a website or way to find out his position.
Lee McGroarty does not specifically address the issue in his immigration section. However in discussing what to do with the illegal immigrants already here, he proposes a program that would allow them to stay in the country. While in the program they would have to adhere to certain standards including, "No welfare programs or government assistance available while in program."
Philip Liberatore does not mention the issue of illegal immigration on his site.
Michael Williamson does not state a specific position but does mention the issue on his site under the immigration section. "Michael Williamson, a front line criminal justice professional has seen the streets of Los Angeles invaded by illegal aliens who have enjoyed the sanctuary protection of Special Order 40, taxpayer paid in-state school tuition for illegal migrants, and government acceptance of the sham matricula consular identification cards from Mexico."
Louie Contreras does not currently have a campaign web site.

42nd Candidates on Birthright Citizenship
I thought I would see if any of the 42nd Congressional candidates have a position on this important.
Obviously Rep. Gary Miller opposes automatic citizenship for children of illegal immigrants since he is a co-sponsor of the bill that would clarify the 14th Amendment. That clarification would ban automatic citizenship for children born to parents illegally in the United States.
David Su does not have a web site yet, so we can't find out his position.
Philip Liberatore does not address his positions on illegal immigration on his web site.
Lee McGroarty's section on immigration says,"Children born in the United States are citizens under the Constitution. However, those not born here and are under this program will not benefit from any public assistance." (The second sentence seems to be missing a word, but I copied the quote just like it is on the web site).
Local Members of Congress on Birthright Citizenship
Rep. Gary Miller, a co-sponsor, addressing the costs of automatic citizenship says, "You have many people coming to this country illegally. They come to this country and have babies. The children are citizens. The children are eligible to go to school. They receive food stamps and social programs. The American taxpayers are paying for it."
Rep. Joe Baca calls the bill "unconstitutional."
Rep. Grace Napolitano declined comment on the bill.
Rep. Buck McKeon, a co-sponsor who represents portions of San Bernardino County, addressing the need for the bill says, "There's an incentive for people to come here and quickly have a baby. Since the baby is a citizen, it's harder to send the family back to where they came from if they came illegally. Now you have a citizen and it would split up the family."
Rep. Jerry Lewis, according to the article, has not yet taken a position on the bill.

Candidate Filing Begins Tuesday
Candidates for office must return nomination papers and pay the filing fee by March 12. Candidates for the U.S. House of Representatives, State Senate and State Assembly must have 40 valid nomination signatures. The filing fee for the U.S. House is $1,740. The filing fee for the State Legislature is $952.91.
Candidates can offset the filing fee by collecting signatures in-lieu. The signature in-lieu forms have been available since January 4 and are due by February 25. We explained more about the signature in-lieu process in early January.

Congresswoman Diane Watson to Retire
Two Democrats and two Republicans had already declared for the seat, but the Watson retirement should bring several more candidates. Karen Bass, former Assembly Speaker, is rumored as a possible candidate.

Earl is involved with the San Bernardino County Republican Party and California Republican Assembly (CRA).
Earl was elected to the San Bernardino County Republican Central Committee Central Committee in 2008. He is the President of the West Valley CRA and 32nd Senate District Deputy Director on the CRA's Board of Directors.
In 1994 he won the Republican nomination for the 32nd Senate district. He was defeated in the General Election by Ruben Ayala 60.7% to 39.3%.

Orange County Register: Running for Congress costs a million
Dena writes, "The Center for Responsive Politics, which is the best in the business in tracking political money, found that in the 2008 election the odds were 302 to one that someone who spent less than $1 million was able to knock off an incumbent.
In the 2004 House races, not one incumbent was defeated by a challenger who had raised less than $1 million."
As we wrote last week 42nd candidates Rep. Gary Miller and Lee McGroarty filed their fundraising reports with the FEC. Gary Miller raised $58,394 in the 4th quarter of 2009. He spent $18,695 and has $950,191.76 cash on hand. He has a debt of $94.10.
Lee McGroarty raised $1,450 in the 4th quarter of 2009. He spent $7,499.91 and has $1550.09 cash on hand. He has a debt of $14,599.15. McGroarty raised a total of $6,550.00 for 2009.
Phil Liberatore officially formed a committee with the FEC last week, which means he expects to spend or raise at least $5,000 during his campaign.
Why does money matter in the 42nd?
There are three Republicans challenging Miller in the primary. McGroarty has raised the most ($6,550), but has nearly $15,000 in debt and only $1500 cash on hand. The others have yet to raise $5000, which would require they file with the FEC.
Citizens are upset and are looking to vote against incumbents, but with three challengers to choose from, who do you vote for against Miller? Dividing the anti-Miller vote three ways won't beat Miller, which is what will happen unless one of the candidates raises enough to do mailers on a regular basis and rise above the other two.
There are about 171,000 registered republicans, so there are probably around 80,000-90,000 households for mailing purposes. A mail piece, just for mailing, would probably cost close to $25,000.
The three challengers need to either start raising lots of money or loaning their campaigns lot of money. Liberatore and McGroarty both own businesses and probably have money to loan their campaigns.
In the 2008 42nd Democratic primary, two candidates filed with the FEC for spending more than $5000. Ron Shepston, who finished third, spent $105,817. Ed Chau, who won the Democratic nomination, spent about $65,000 in the primary and $347, 351 including the General election.
At this point in the 2008 election cycle (2007 end of year filing) both had raised more than the three 2010 Republican challengers. Shepston had raised $24,407.86, had loans of $4131. 98 and had $6080.01 cash on hand. Chau had raised $12,180, loans of $19,000 and had $13,747.85 cash on hand.

60th district Assemblyman Curt Hagman filed reports for two committees. Together he raised $133, 834.96 and spent $109,101.64. One committee has no cash on hand. The other has $29,631.45 on hand.
61st Assemblywoman Norma Torres raised $146,948.89 and spent $109,586.51. She has $154,698.43 on hand.
32nd State Senator Gloria Negrete McLeod has two committees. Together she raised $61,221.00 and spent 8761.45. Combined she has $990,880.72 on hand.

Conservative Party (California) PledgeFor Local, State and Federal Elected Office
I (Candidate) hereby agree to adhere to the following stipulations in order to gain the endorsement of and/or support from the Conservative Party (California), hereinafter referred to as PARTY.
As a Candidate for elected Office, I pledge to:
1. Hold any combination of elected Federal offices for a maximum of 18 years, consecutive or otherwise, but not exceeding three (3) terms (18 years) in the U.S. Senate and four (4) terms (8 years) for the U.S. House after which I will resign and not seek re-election to those offices.

7. Disclose immediately when any of my personal investments could benefit from any pending legislation on which I will vote and outline any potential conflicts of interest.
8. Not develop or support any legislation that contains language on spending for budget items unrelated to that specific Bill (“Riders”).
9. Not support or submit any off-budget Earmarks. I further pledge to publically expose all Earmarks and those Legislators who submit them.
10. Promote and support fiscal responsibility for Federal and State governments, a Federal and State Balanced Budget Amendment and a Presidential Line Item Veto.
11. Consistently vote to defund, or vote against appropriating any money for, any federal program or activity not specifically authorized by an enumerated power in the United States Constitution. I further pledge to provide the specific constitutionally enumerated power for any federal program or spending activity for which I do vote to enact.
12. Have Town Hall meetings as often as practical but not less than once a Calendar quarter (3 months) and/or Monthly Webinars.
13. Be evaluated for adhering to and supporting the PARTY Platform. A Report Card will be published based on overall voting record, attendance and voting frequency and missed votes.
14. Resign if the preponderance of public evidence indicates that I have committed sexual misconduct or promiscuity or adultery or repeated abuse of illicit drugs or

Conservative Party Endorses in 42nd Republican Party Primary?
The home page for the California Conservative Party, which has a link to the McGroarty for Congress website, states, "The time has come for true Conservatives and like-minded Independents to secede from their respective parties and join the Conservative Party of the United States."
The party pamphlet states on page 2, "It is the belief of the Conservative Party that true conservative representation can be provided only by establishment of a new national party. Present affiliation within any political party that leads to a significant compromise of values should be impetus for a citizen to search for a new organization and leadership; the Conservative Party!"
Line 13 of the candidate pledge, which must be signed "in order to gain endorsement," states McGroarty will, "Be evaluated for adhering to and supporting the PARTY Platform. A Report Card will be published based on overall voting record, attendance and voting frequency and missed votes."
Line 5 of the candidate pledge states the candidate will, "Accept funds or contributions only from individual US citizens and PAC’s or corporations or groups specifically approved by the PARTY. So does Lee McGroarty believe that "true conservative representation" cannot be found in the Republican party? Why is McGroarty giving final review of his donations to a political party he is not a member of? Does McGroarty plan on leaving the Republican Party if elected to Congress in order to comply with the platform?
I think these are questions his three opponents should ask.

Update: Phil Liberatore Uses Book Endorsements for Campaign?
In it we mentioned that Liberatore was using two quotes supporting his book as campaign endorsement quotes. One was from Warren Duffy, minus references about God and the book. The other was from Jack Hayford and was taken word for word from the book endorsement.
These quotes were obviously about the book and it is hard to believe they were accidentally put on his campaign website. Especially when the Duffy quote was changed to omit God and the phrase, "read this book," from a sentence. Maybe he just thought no one would notice.

Liberatore Uses Book Endorsements for Campaign?
The Warren Duffy endorsement quote seemed interesting. It said, "For more than a decade, Phil has helped our family and business to make more and save more." That doesn't seem like a quote someone would use to support a Congressional candidate.
So I did a quick google search and what did I find?
The amazon.com page for Liberatore's book which also had a quote from Warren Duffy. This one said," For more than a decade, Phil has helped our family and business to make more, save more and give more God s way. If that expresses your heart, read this book."
So, Phil took the book quote and took off the part that mentioned God. Really? Now it is possible that Warren Duffy just gave him a similar quote. So, I looked to see if any of the other quotes looked familiar. One did, word for word!
The quote from Jack W. Hayford, President of the International Church of the Foursquare Gospel and Chancellor of The Kings College and Seminary, is the same one on his campaign site. It states,"Phil is an authentic servant of Christ with great qualifications to serve you and me with problem-solving keys to managing our money."
So, the two national figures who he lists as endorsing his campaign endorsed his book. But did they actually endorse his candidacy?
Normally I would believe a candidate when they claim to have endorsements but after Lee McGroarty, another Congressional candidate, made up endorsement quotes, I have learned to verify before believing.
UPDATE: The Liberatore web site has removed the two mentioned "endorsements."

Bob Huff Announces "There Ought to be a Law" Contest Winner
Senator Bob Huff (R – Diamond Bar) announced today that James M. Dorn, from Chino Hills, CA has been chosen as this year’s There Ought To Be A Law contest winner.
After reviewing over 40 submissions, Senator Huff has decided to take on Dorn’s idea as part of this year’s legislative package. Dorn’s bill will ensure potential legislation is available to the public and to legislators for at least three full business days prior to a vote in any committee in either house after it has been amended.
“Providing adequate time for legislators and the public to review bills gives Californians a way to hold legislators accountable, which is essential to a more transparent government,” Senator Bob Huff said. “I am pleased to carry Mr. Dorn’s idea and this powerful message to the halls of Sacramento.”
Although the California Constitution currently provides for a 30 day review period after each bill is introduced, there is neither a mechanism in place to ensure it is actually reviewed, nor is there any set time set aside for review once the bill has been amended. This 72 hour period will help remedy this issue.
There Ought To Be A Law submissions came in from across the district and touched on a wide array of issues. Senator Huff is happy about the response to the contest.
“This contest provides the chance to hear directly from constituents about what matters to them most,” commented Senator Bob Huff. “It is a great way to gain a better understanding of what is important to the people who are affected everyday by decisions in Sacramento.”
Besides having his idea taken through the legislative process, Mr. Dorn will be invited to join Senator Huff for lunch in Sacramento and will receive a California State flag that has been flown over the Capitol.

Have Candidacy, Will Travel
In 2008 he filed paper work with the FEC to seek the 43rd Democratic nomination against Democratic Congressman Joe Baca but never filed the paperwork to get on the ballot.
In 2008 he finished last in the race for La Habra City Council.
On January 4, 2010 he pulled Signatures In-Lieu papers to seek the Democratic nomination in the 42nd Congressional race. He filed them on January 19.
That same day, January 19, he pulled signatures In-Lieu papers to seek the Democratic nomination in the 40th Congressional district.
Is he just a full time candidate, moving around from district to district? One has to wonder why someone would vote for him to represent them?

Congressional Candidate Su Speaks at Diamond Bar Meeting
Some highlights include
- He is a recent graduate of the University of California-Riverside.
- He decided to run after graduating from UCR because, "I felt like, you know, I wanted to get into the industry of helping people."
- He said that he has spoken with small business leaders in Yorba Linda, Brea, Diamond Bar and Chino Hills about his plan to "provide massive tax cuts to local businesses and small businesses." The plan would include cutting all federal taxes to businesses that make $500,000 or less in gross income.

Ron Shepston files 4th Quarter FEC Report
Shepston has not publicly announced if he will once again seek the Democratic nomination for the 42nd Congressional race, but with that amount of debt it seems doubtful. Shepston finished last in the 2008 Democratic primary.
Michael Williamson, who finished second in the 2008 42nd primary, and Louie Contreras are both seeking the Democratic nomination this year.

Mr. Williamson commented the following to our story, "This is Michael Williamson. In answer to "little neddy knickes", yes, I have spent the last 10 years opposing many policies and practices. Additionally, one might consider that my public opposition, via a website, including, my critical account of Special Order 40, put me in the administrative cross hairs of a large police system opposed to what I think. Read the assessment I wrote of Special Order 40 in my website. Then if you disagree perhaps it will be an informed disagreement."
I went to his site, to read about all of the things he did in opposition of Special Order 40. This is what I found in his immigration section.
"Do not fall for the misleading statements of candidates suddenly "talking tough" on illegal immigration issues. Michael Williamson, a front line criminal justice professional has seen the streets of Los Angeles invaded by illegal aliens who have enjoyed the sanctuary protection of Special Order 40, taxpayer paid in-state school tuition for illegal migrants, and government acceptance of the sham matricula consular identification cards from Mexico. "
Where is, "the assessment I wrote of Special Order 40"? One line is it? His contribution is that he has seen the effects of Special Order 40? How disappointing. Haven't we all seen the effects of Special Order 40, and similar orders, in our cities.
Williamson says he has spent the "last 10 years opposing many policies and practices." But the only example he cites is his campaign website. Just like a typical candidate for office. They call their candidacy the contribution to the fight of illegal immigration but show no examples until then.
I invite Mr. Williamson to tell us, via a comment, what he has specifically done to change Special Order 40. We will gladly post it.

Daily Bulletin forgets about Phil Liberatore, David Su and Michael Bryant?
In covering the 32nd State Senate race they mention it will be tough to beat Senator Gloria Negrete-McLeod, her 2006 primary opponent will not challenge her and that she didn't have a 2006 general election opponent. They fail to mention that Michael Bryant of Ontario has pulled Signatures in-lieu papers to begin the process of challenging her.
The story about the 42nd Congressional race mentions both Democratic candidates, Louie Contreras and Michael Williamson, but only mentions that Lee McGroarty is challenging Congressman Gary Miller. It lists Lee McGroarty's criticisms of Miller. Phil Liberatore formed a Congressional committee with the FEC over a month ago to challenge Miller in the Republican primary. He has also began the filing process with the Los Angeles County Registrar of Voters. David Su pulled Signatures in-lieu forms with the LA County Registrar about a week ago to also join the primary. Neither Liberatore or Su appear to have been given a chance to say why they are running against Miller.
I found that these candidates were running by checking with the FEC and the three county Registrar of Voters offices. One would think the Daily Bulletin would do the same. It is hard for a challenger to beat an incumbent like Negrete-McLeod or Miller. They will rely heavily on free publicity like the media. It is unfortunate that they were not featured in this article. Hopefully they will be in in future articles about these races.
