We were fortunate to have been able to do an email interview with 42nd Congressional candidate David Su. The past two days we posted the first two parts of the interview.

An Interview with David Su Part 2 of 3

Statement on Phil Liberatore's FEC Filing
This week we posted twice that the Phil Liberatore Campaign filed their FEC filing electronically with the FEC on April 19. That date is late, so we reported that they may be subject to a fine.
Today we received the following statement.

I am the campaign treasurer for the Liberatore for Congress Committee. I hereby inform you that our filing was submitted on-time and in compliance with FEC regulations and Federal law. We filed an electronic disk by overnight mail prior to the 11:59 pm EST 4/15/10 deadline, and filed again with the Electronic Filing Office on 4/19/10 for the convenience our FEC analyst Stephanie Shaw. Any statement to the contrary is erroneous and I must assume is made with malice toward my client. Please remove or amend your comments or I shall be forced to take legal action against this site for slander.

While we understand the concerns of the Liberatore campaign, the FEC site still shows April 19 at 16:04 as the filing stamp. If that changes we will post a full retraction and change all posts related to this matter. We are simply going off of the FEC data available to the public. We don't know that the Liberatore campaign mailed something in until it is received. We stated that the Liberatore filed electronically in our posts. That is an accurate statement, the Liberatore campaign filed electronically on the 19th. Ultimately the FEC decides fines based on their information, not us.
We have made sure that every post says "may" and "if."
Hopefully this post, and our side of the story, addresses their concerns.

42nd Republican Primary FEC Review
All four candidates for the Republican primary in the 42nd Congressional district have now filed their fundraising totals with the FEC.
Rep. Gary Miller shows $1,053,383 cash on hand. During the 1st quarter he raised just under $400,000 and spent a little over $200,000.
Phil Liberatore raised $15,911, loaned his campaign $100,000 and spent $112,340. He has $3,570 cash on hand. Liberatore filed electronically four days late, so he may be facing a FEC fine. My understanding is that a fine is automatic since there are no exemptions for filing late.
Lee McGroarty raised $1700, loaned his campaign $8000, and spent $8179.32. He has 3070.77 cash on hand. His campaign now owes $27,030.16 in debt.
David Su raised $2151.43. He spent $1891.43 which leaves him with $260 cash on hand.

Phil Liberatore spends $112,000, files late
42nd Congressional candidate Phil Liberatore has filed his 1st quarter FEC forms four days late. His filing showed he raised $15,911, loaned his campaign $100,000 and spent $112,340. He has $3,570 cash on hand.
Liberatore electronically filed four days late. His form shows it was filed April 19. According to the FEC the fine for filing four days late, and having a "level of activity" between $200,00 and $249,999, is $1,800. According to the FEC there are no exemptions for filing late.
If found by the FEC to be filing late, it will give Liberatore's opponents a campaign issue because a FEC fine is a BIG deal. Also it is not something you want to see on a campaign mailing and in newspaper articles.

Phil Liberatore First up with Television Ad
Phil Liberatore is the first candidate in the 42nd Congressional race to run television ads. I saw a Liberatore for Congress ad today while watching Fox News.

California Republican Assembly Endorses Rep. Gary Miller, Again
Last month we reported that the California Republican Assembly (CRA) had endorsed Rep. Gary Miller. Last night I noticed on Phil Liberatore's Twitter page that he had attended an event seeking the CRA's endorsement.
I called a CRA friend who said they did the 42nd Congressional district endorsement again for whatever reason. Miller, Liberatore and Lee McGroarty all spoke to the group and Miller received their endorsement again. My friend thought that Rep. Gary Miller's endorsement was unanimous. It had to be a blow to McGroarty and Liberatore not to get a single vote, if it was in fact unanimous.
Liberatore had the following to say on his Twitter page about it.
The CRA has lost their mind voted to endorse big spender Miller. The conscience has been silence.
The conscience of the republic party was not heard today. Miller defended TARP and they endorsed.
