Esiquio Uballe, the Democratic candidate in the 72nd Assembly district has put up a campaign web site. Uballe is challenging Republican Assemblyman Chris Norby.

Website up for 61st Assembly Republican Candidate Ray Moors

Ray Moors, the Republican candidate in the 61st Assembly District, has put up a campaign website. The 61st is currently represented by Democratic Assemblywoman Norma Torres.

Some of Moors' "platform,"

"I will research and propose legislation that will bring businesses back to California."

"I will propose legislation that will remove the boot of the state unions and lobbyists from the throats of the middle class taxpayer and small business owner."

"I will support to have a new State Constitutional Convention that will model our constitution after our nations which is 4400 words long and with 27 amendments. Presently, our state constitution is an incomprehensible 40,000 word, attorney written, legal morass of English and Latin with over 500 revisions and amendments."

42nd Election Results Updated

The results for the Republican primary in the 42nd district have been updated (3:32pm today) on the Secretary of State's web site. The result is the same but the percentages have changed slightly. Phil Liberatore has gone up 0.4%, while the other three candidates have gone down 0.1% to 0.2%

Robert Vaughn not re-elected

Robert Vaughn, who had claimed he was the Chairman of the Los Angeles County Republican Party until a judge ruled he was not, was not re-elected to the Party's county Central Committee. Only members of the Central Committee can hold leadership positions in it.

We first covered the controversy surrounding Vaughn after a Phil Liberatore for Congress mail piece claimed Vaughn was the Chairman of the county party and had endorsed Liberatore over Rep. Gary Miller.

Even though defeated for Central Committee, Vaughn is still a candidate for Congress. He is challenging Rep. Grace Napolitano in the General Election.

In the election for Central Committee Vaughn placed 17th out 0f 18 candidates with 2.35% of the vote. The top seven were elected.

Rep. Tom McClintock responds to Phil Liberatore allegation, says he "should know better"

On Wednesday night on the Rick Amato show, Phil Liberatore and Amato claimed that Rep. Gary Miller had used a 2008 endorsement from Rep. Tom McClintock. Amato said that Miller sent out an email that said that Rep. Tom McClintock endorsed Miller. Amato said that the endorsement was from "two years ago," but didn't say why he thought that. Liberatore agreed with Amato.

Today we received the following comment from Rep. Tom McClintock stating that he did endorse Miller.

Statement from Rep. Tom McClintock: "The claim that Gary Miller improperly claimed my endorsement in the 2010 Republican primary is absolutely and completely false, and the people making it should know better. I enthusiastically support Gary Miller's candidacy and was proud to endorse him in the recent primary. On the floor of the House of Representatives I have seen first hand -- day in and day out -- his devotion to taxpayers and to the conservative cause and I could not possibly be stronger in my respect and support of him."

A Message from Congressman Miller...

I am humbled and honored for the outpouring of support I received during this past election. It was a hard fought battle—a lot of money was spent by my opponents—but my supporters and I always remained true to our core conservative values, looked past the lies and false assertions, and pressed on.

Thinking back on the election, I’m disappointed so much money was spent by Republicans to attack Republicans—and how that money could have been used to take back Congress in November or at least defeat the U.S. Senate’s most liberal member, Barbara Boxer.

But this election allowed me the opportunity to broadcast the need to lower taxes to jump start our economy, enact tougher immigration laws to stop taxpayer handouts to illegals, rebuild our crumbling roads and infrastructure, and decrease government spending.

Times are tough and voters are angry—and rightfully so. Congressional Democrats and President Obama have increased taxes, socialized our healthcare and dumped billions of taxpayer dollars to prop up union-plagued industries.

And Democrats are not done yet: amnesty for illegal immigrants and a Cap and Trade tax scheme are right around the corner.

Every day I’m fighting tooth and nail to stop them—as I believe the residents of the 42nd district expect me to do.

For at the end of the day, it’s the voters who are my employer and I am truly honored they have once again put their faith and trust in me to represent their interests in Washington.

Phil Liberatore comments on election; Received Death Threat, Dogs killed

Former 42nd Congressional candidate Phil Liberatore was a guest on the Rick Amato show last night.

Some of the comments;

Liberatore said that during the campaign he received a death threat and had his two dogs killed. He alleged that the day after they were killed a picture of one of the dogs appeared in a campaign mailer from Rep. Gary Miller. I wonder why this is the first we have heard of the death threats or the killings of his dogs from Liberatore. Liberatore didn't say anything about a police investigation or how or why he thought it was a picture of his dog in the Miller mail piece.

Liberatore said that he was going to look at his future political options and try to "keep the momentum going."

When asked by Amato if he had heard from Miller or any of the other candidates he said, " No I haven't heard from anybody." I wonder if he knows that it is customary to call the winner, not the other way around. Former 42nd candidate Lee McGroarty commented on our blog yesterday that he would be calling Miller, Liberatore and David Su.

Amato said that on Monday Miller sent out an email that said that Rep. Tom McClintock endorsed Miller. Amato said that the endorsement was from "two years ago," but didn't say why he thought that.

My wife Dana and I want to thank everyone who came out and voted for me in this election. You will never know how much this means to me. It is a tremendous honor to have you put your faith in me and the ideas I put forward to ‘Take Back America’.

I also want to thank the hundreds of volunteers who put in precious time placing yard signs, stuffing envelopes, making phone calls and sending out all those postcards. Your enthusiasm and encouragement kept me going all those late nights and early mornings. I would also like to thank the tremendous team that served during the campaign.

While we lost this race I do believe a clear message has been sent, as the incumbent received less than 50% of the vote. I call upon Congressman Miller to take note as to how We The People voted. I am disappointed the vote was split amongst three challengers, as it is evident we had the momentum going into the final weeks. However, if I had to do it all over again I would enter the race again tomorrow.

Having walked the neighborhoods and meeting the people of our community personally was one of the richest experiences of my life. I entered this race because I have a great concern about the direction of our country. But as I walked the district meeting our neighbors and experiencing the support of the voters, I am hopeful. I encourage you to get involved on any and every level as our Founding Fathers envisioned a country of citizens in leadership not career politicians.

As you know the primaries are over and the results are in. Congressman Gary Miller, the GOP incumbent, my opponent has retained his seat. I know many of you are disappointed, some of you are discouraged, but don’t be. I know I’m not. I am content with my results and very humbled on the journey that I had embarked on. I fought the good fight and decided to run for Congress because this country needs real change and ran with sheer passion, the strength of conviction to stand up for what I believe in. I just want to say congratulations to Congressman Gary Miller on his reelection and I will be supporting him to continue to fight for his constituents and to be a voice in Washington. Freedom is precious and I too will continue to fight, to contribute and to do what is right in improving the quality of life for all Americans.

This message is for all Americans, tax payers, and citizens everywhere. Whittier Daily News story on 42nd race, Liberatore comments

The Whittier Daily News has a story on the 42nd race including some strong comments from Liberatore.

Liberatore told the paper, "Gary Miller had the press in his pocket. He controls all of the cities. He's the incumbent and everybody is bowing down to this guy. It was hard to get any response from the media."

The article spoke about the amount of money spent on the race. It stated, "Liberatore mailed fliers and purchased newspaper ads, after loaning his campaign $725,000. Miller reported spending about $330,000 but said that only $200,000 was for the campaign. The rest was for office expenses."

Billy Wojciak Wins 42nd Primary Predictions

We asked our readers to guess the finishing order of the 42nd Republican primary. Two readers, Billy Wojciak and MV Conservative, guessed correctly but Billy was the closest on the percentage Miller would receive. He guessed 47%, Miller received 49%.

Lee McGroarty comments on Election

Last evening, my campaign held a celebration party at our home. Lisa and I were so pleased with the turnout. It was a chance for us to say thank you for a truly wonderful year. We couldn't have been more touched by the outpouring of love and support for the efforts of my team, my family and most importantly, my supporters.

Did we win? Absolutely. I can truly hold my head up high knowing we fought a great fight. I believed Congressman Miller needed to be challenged and our goal was to offer a choice to the people of the district. My entering the race assured that. Though I wish I could have gone head-to-head against Miller, others also stood up and challenged. That is Democracy!

As a gesture of goodwill, I will be calling each of my opponents today. For now, I tip my hat to Congressman Miller for his victory. I also applaud Phil and David for their efforts. We all won. Rep. Gary Miller has defeated three challengers to win reelection. With all precincts reporting Miller received 49%. Phil Liberatore was his closest challenger with 37.2%.

My wife Lisa and I would like to thank all our supporters for their tireless efforts and devotion to our campaign. A year ago, I felt our economy would be in dire circumstances, the incumbents would be under attack, and the country would want to move back to common sense conservative values. I was right on all three fronts.

A year later, I am so proud of our campaign. We have fought hard and have taken on the Republican establishment and a 6 term Congressman. We set out to improve the Party and to let our Congressman know that We The People are watching and we will act when you let us down.

The 42nd Republican Primary: Some things to watch for

Here are a few things to watch for today in the Republican primary in the 42nd Congressional district.

Orange County: More than 2/3 of registered Republicans in the 42nd live in Orange County. However, none of the four candidates live there. This is where the mail pieces from Rep. Gary Miller and Phil Liberatore will separate them from David Su and Lee McGroarty. Name id means a lot in an election.

Candidate's City: If Miller is losing Diamond Bar or Liberatore is losing Whittier, it is a bad sign of things to come for them. This is especially true for Diamond Bar. Miller has been representing the city since he started in politics. If he loses there, the race is lost.

We will be posting results and commentary on what the results mean throughout the night so please check in later tonight.

Lee McGroarty responds to Marc Harris and not being able to speak at Tea Party Event

Yesterday we posted a story that 42nd Congressional candidate Lee McGroarty was not allowed to speak at a Tea Party event, while fellow candidate Phil Liberatore was. Later Marc Harris, the person several commenters stated was the person who didn't allow McGroarty to speak, responded to the issue. In his response Harris said there was, "suspicion now being raised that McGroarty has made a back-room deal with Miller to stay in the race in order to split the vote, and ensure Miller's re-election."

Phil Liberatore loans himself another $150,000; Lee McGroarty raises $3,400

According to documents filed with the FEC today, 42nd Congressional candidate Phil Liberatore has loaned himself $150,000 bringing to $725,000 the total Liberatore has loaned his campaign.

42nd Congressional candidate Lee McGroarty reported on Sunday that he raised $3,400 from two donors.

Phil Liberatore Email has new 42nd Poll, now he has 56%

Earlier today we posted a poll from 42nd Congressional candidate Phil Liberatore that shows him ahead of Rep. Gary Miller 27% to 21%.

I have just received an email from the Liberatore campaign that shows him ahead of Miller 56%-44%. So he gained 29% in one day, Lee McGroarty and David Su received 0%, and no one was undecided? Seems unlikely.

2008 Polling in the 42nd Congressional District

In September 0f 2008 Democrat Ed Chau, who was challenging Rep. Gary Miller in the General Election, released a poll. The campaign said, "Ed Chau leads Gary Miller by 44% to 38% with 18% of the voters undecided."

On Election Day, Miller received 60.2% and Chau received 39.8%. So in a Democratic year Miller received 4% of Chau's supporters from the poll and all of the undecideds. Unlikely. It is more likely that the poll was inaccurate.

Phil Liberatore Releases Poll that shows him Defeating Rep. Gary Miller

The Liberatore campaign has released the following press release that contains poll numbers on the 42nd Republican primary.

I noticed a couple of things that make me question the validity of the poll. First, it didn't include David Su or Lee McGroarty, which is why the undecided is so high. We wouldn't know if McGroarty or Su have 30% because they didn't ask. Second, who conducted the poll? It could have just been Liberatore staff calling. Third, who was contacted? The release doesn't say they only contacted Republicans or registered voters. It only says, "1,281 residents of the 42nd district ." Did they just call supporters? Finally, how were the questions asked? Was it a "push poll." We will find out tomorrow how accurate it is.

Response from Marc Harris?

We have received the following response to our earlier post about 42nd Congressional candidate Lee McGroarty not being allowed to speak at a Tea Party event yesterday. We don't know for sure that this is in fact from Marc Harris. It was sent via email and was forwarded twice. The emails listed are from leadership in groups associated with Harris, so we have a strong belief that this is in fact from Harris.

I thought it was funny that Harris said, "Funny, you don't see Miller attacking McGroarty." I guess Harris hasn't been following the race long enough. The Lee McGroarty for Congress web site that Miller put up comes to mind.

Thanks for this post, Miller team....This is only going to add more fuel to the suspicion now being raised that McGroarty has made a back-room deal with Miller to stay in the race in order to split the vote, and ensure Miller's re-election. (Do people do such things in politics???)

Otherwise, why would Miller's supporters here give a darn about this obscure incident, and slant it so far from the facts?

The FACTS are that: a) I was not the "host" of this event, it was put on by a local coordinator, and I have no authority to determine who speaks, b) I was NOT the one who denied McGroarty's request to speak, it was the local coordinator, c) it was on private property, and the owner participated in setting the agenda and speakers and, again, I have no authority to tell a private property owner what can go on on his property, d) I have NOT endorsed Liberatore: I support the Tea Party leaders and members; accordingly, I will act in a manner consistent with the results of numerous emails, phone calls, caucuses, and straw polls among local Tea Parties which show greater support for Liberatore.

Why did a Phil Liberatore supporter block Lee McGroarty from speaking?

Yesterday there was a Tea Party event in Anaheim. According to several comments we received, 42nd Congressional candidate Lee McGroarty attended the event but was not allowed to speak. However, 42nd Congressional candidate Phil Liberatore was. In fact, several people who have endorsed him spoke as well.

According to the comments we received, Marc Harris, who hosted the event and has endorsed Liberatore, is the person who denied McGroarty the chance to speak. Harris has appeared in mail sent by the Liberatore campaign. He is the Orange County Coordinator for the Tea Party Patriots.

Hello everyone! So there are 2 days left before the primaries and I just wanted to say that it has certainly been a humbling experience for me as I am embarking on this journey all the way to the finish line. I never would’ve imagined of even getting to this point yet alone having the privilege to even run for Congress. I am the youngest congressional candidate in the country right now. I know in certain countries you wouldn’t even be able to run a company yet alone get into politics at my age. This clearly depicts what a great nation we live in, a nation where we are allowed to express our opinions, concerns, and ideas in any shape or form without the fear of persecution or tyranny. This great nation was founded upon the principles of our fore founding fathers which fought a tyrant 3000 miles away in order to secure a birth of a great nation, so people may live free to pursue their own version of happiness without the impediment of government. I know this country has given me all the opportunities and possibilities, something no other country in the world could offer. I know that I have a great deep genuine love for America and she is currently being destroyed from within. I feel that the leaders in Washington aren’t listening and playing politics as usual which will eventually lead America to destruction. I know we cannot afford adding more deficit; to our current $13 trillion dollar debt that we are facing. I know people are losing their jobs, people are losing their savings, people are wondering how they are going to take care of their families, (especially the 99ers) and all that hope and change platform that President Barack Obama ran on during his campaign, is flickering away, like a candle flame ready to burn out. People are losing hope and America is screaming for leadership. I know the conservatives in this country can lead and has proven that before in the past. However in this current time of crisis our nation is facing, the only party that has that capability has lost all accountability, responsibility, and trust with its own base and with the American people.

Talk Show Host Claims David Su and Lee McGroarty under 5% in 42nd.

On Friday, we posted a story about how 42nd Congressional candidate Phil Liberatore and his supporters have been publicly stating that Liberatore is "winning" in polls or that the polls are "tight." We wondered why Liberatore wasn't posting the results in an effort to win over David Su and Lee McGroarty supporters who want to defeat Rep. Gary Miller.

Liberatore still hasn't released any polls but his supporters are trying to make it seem like Su and McGroarty have no shot.

Rick Amato, who hosts the Rick Amato Show in San Diego, has posted the following in regards to Phil Liberatore.

"UPDATE: The latest internal polling numbers show Liberatore and Miller neck and neck. There is a risk that unless one of the other candidates drop out (other candidates polling at less than 5% of the vote) sadly they could be responsible for sending Miller back to Washington."

Amato uses the word "candidates," so he is implying that McGroarty and Su are under 5%. But for all we know Liberatore could be at 6%.

If Liberatore was winning, or with in a few points, they would release the poll because gaining an extra point or two from Su and/or McGroarty would be all he needed.

42nd Republican Primary Predictions

With two days left until Election Day we welcome our readers to predict the finishing position of the four candidates in the 42nd Republican primary.

We have no prizes to offer but will post the comment name used in a story announcing who correctly guessed the finish. As a tie breaker also guess the percentage of the vote the winner will receive.

FEC Complaint against Lee McGroarty dismissed

The FEC complaint filed against 42nd Congressional candidate Lee McGroarty has been dismissed by the FEC on a 6-0 vote. The memo presented to the Commission stated that McGroarty had corrected two of the violations. The other was a mistake on the part of godaddy.com.

The certification of dismissal is dated May 12 but I found it on the FEC web site today.

Where are the polls that show Phil Liberatore winning?

For the last few weeks Phil Liberatore and his supporters have been touting polls that they claim show him "winning" or "close," in his primary race against Rep. Gary Miller.

On May 18, Mike "Bogey" Boguslawski said on the Rick Amato Show, "Right now. Right this minute...Liberatore's winning the poll right now. He's winning it."

This past Tuesday while talking about polls, Phil Liberatore told the Rick Amato Show, "It's real tight right now. This race is real tight." Rick Amato said he looked at some polls and the "polls are very, very tight." Amato also said some candidates in the 42nd race were "polling 2 and 3 and 4 percent of the, of the, of the votes." Another person on the show, Ken, said that the polls are "going up and up as we go day by day by day."

But where are these polls? If Liberatore was really winning why wouldn't he release his polls in an effort to show Lee McGroarty and David Su supporters that only he can beat Miller? Is Liberatore just trying to fire up his base?

I guess we will find out in four days if Liberatore and his supporters are telling the truth.

Lee McGroarty Comments on Daily Bulletin Editorial Support

We are going to take some credit for this. Earlier today a McGroarty supporter was upset the Daily Bulletin endorsed Rep. Gary Miller and called them liberal. I commented the following, "If I was on your campaign I would be using "favorite from among those challengers," and McGroarty "has tangled quite a bit with Miller in the campaign," in everything I could for the next five days."

Now the McGroarty has issued the following comment, which is a good move since he needs to show why voters should pick him instead of Phil Liberatore or David Su.

Daily Bulletin Picks McGroarty as Favorite Among Miller Challengers

The Daily Bulletin has published an article supporting incumbents David Dreier and Gary Miller, but has called Lee McGroarty their favorite to challenge Miller.

Daily Bulletin endorses Rep. Gary Miller, calls Lee McGroarty "favorite" of challengers

The Inland Valley Daily Bulletin, on their editorial page, has endorsed Rep. Gary Miller.

They wrote,

"The challengers are running to the right of Miller, but we can't see much daylight to his right. Miller's positions are very conservative in most areas - illegal immigration, for example. He lands to our right on many issues, but we like that you always know where he stands and he doesn't shift with the political winds.

Miller is a developer, and some of his land dealings with cities in and around the Inland Valley have raised eyebrows and caught his opponents' attention. We have questioned some of them ourselves, but never found wrongdoing. He says he gets more scrutiny and runs up against more roadblocks - not fewer - than the average developer because he's a congressman.

We trust he will continue to work to reduce the debt we're leaving for our children and grandchildren - and that's enough for an endorsement in this Republican primary."

In regards to Lee McGroarty they wrote,

"If we had to pick a favorite from among those challengers, it would be Chino businessman Lee McGroarty, who has tangled quite a bit with Miller in the campaign."

Phil Liberatore loans campaign another $100,000

According to documents filed with the FEC yesterday, 42nd Congressional candidate Phil Liberatore has loaned himself $100,000 bringing to $575,000 the total Liberatore has loaned his campaign. Liberatore also reported a donation of $2,400.

Currently all Congressional candidates must report any donations or loans of $1,000 or more to the FEC within 48 hours.

Since we last posted an update on the "48 hour" donations, Rep. Gary Miller has received two donations of $1,000 each.

The two remaining Republican primary candidates, David Su and Lee McGroarty, have not filed any "48 hour" notices.

Phil Liberatore sends out email on Rep. Gary Miller's Service record

42nd Congressional candidate Phil Liberatore has sent out an email titled, "Miller Misrepresents Military Record‏." This after Rep. Gary Miller released military records and Lee McGroarty said of him, "One of my opponents, who never served our country, is calling out Miller for his military service and is “grandstanding” on an issue he knows nothing about."

Liberatore mostly used parts of the Harper's Monthly article and quotes from three retired military members who make up his "Military and Veterans Affairs Advisory Committee." Two of the committee members called on Miller to releases his records, which he had already done when I received the email.

I received the email at 4:45pm. We posted the story of Miller placing his records on his web site at 12:15pm.

The Miller Military Records: McGroarty played it right, Liberatore played it wrong

Yesterday 42nd Congressional candidate Phil Liberatore commented on the Harper's Magazine story on Rep. Gary Miller's military service. Liberatore issued his release several hours after the article was published. He also put up a statement on his Twitter page that said, "What disrespect! Miller lied about his military record."

Lee McGroarty waited until after a local newspaper story was posted to issue a press release. McGroarty was able to know the medical reason for the discharge and have the knowledge of more comments from Miller. McGroarty was able to look more thoughtful and not appear to be doing it for political expediency.

Liberatore, on the other hand, looks very political in his actions. So much so, that McGroarty said that Liberatore was "grandstanding." He also looks like he was so quick to put something out, hoping that the media would give him attention, that he has errors in his release.

First, Liberatore's release states, "according to the Harper’s article, Miller was discharged after just 49 days of enlistment in 1967." Problem is that the article doesn't say that.

The article states, "According to his military record, he spent about seven weeks in boot camp at Fort Ord, California between early-September and late-October 1967, at which point he was discharged."

Now Rep. Gary Miller has released his records so we can see how many days he served. According to Miller's Military Service Certificate, and a look at a 1967 calendar, he served 54 days.

So where did Phil Liberatore get 49 days from? Did Liberatore really put out a press release that distorts Miller's military service, while accusing Miller of doing the same thing?

Rep. Gary Miller releases Military Record showing Honorable Discharge

Rep. Gary Miller has placed a "Certificate of Military Service" on his campaign web site.

The document states that he served from September 7, 1967 to October 30, 1967. It states that "Service was terminated by Honorable Discharge."

The site also commented on his military service.

"A lot of fuss has been made about Gary’s military service by the guys running against him—and they’ve made up a lot of lies and fed them to the press. Here are the facts: Gary enlisted in 1967—when he was 18 years old. While in boot camp, Army doctors learned he had a childhood ulcer, which made him ineligible to serve so therefore he received an honorable discharge. To learn more, download Gary’s Certificate of Military Service. Gary has never used his brief time in the Army for political gain."

Lee McGroarty defends Rep. Gary Miller; says Phil Liberatore "grandstanding"

Yesterday we posted a story about an article on the web site of Harper's magazine that looked at the military service record of Rep. Gary Miller. Shortly after the article came out 42nd Congressional candidate Phil Liberatore commented on it.

42nd Congressional candidate, and Veteran, Lee McGroarty has now commented on the matter. A press release issued by the McGroarty campaign says,

"The Vietnam War era was a difficult time in our country. Many future politicians avoided military service during the late 1960's and early 70's but Congressman Miller did not. Miller voluntarily enlisted in the U.S. Army to serve our country. As an enlisted veteran who served his country honorably, Lee McGroarty commends Mr. Miller and his call to duty."

McGroarty went on to say,

"As a veteran, I am very protective of questioning any American who voluntarily serves our country. I am willing to defend Congressman Miller and his record if he was discharged due to a medical reason. The greatest honor bestowed upon an American is to serve his or her country honorably. However, it is the deepest betrayal to misrepresent his or her service. I have the utmost confidence that Congressman Miller will come clean on his record."

The release goes on to say,

"One of my opponents, who never served our country, is calling out Miller for his military service and is “grandstanding” on an issue he knows nothing about. I want to make one point very clear, this is a very uncomfortable issue for me and my campaign. I want to win on the real issues -- jobs and spending where I believe Miller is vulnerable. I am asking Miller to come clean on his military record. It is not a question of “if he served” but whether he served honorably. Congressman Miller, show us your DD 214 so this whole matter can be put to bed quickly and we can get back to the business of explaining our positions on the economy, etc. If you don’t, then I will defend the men and women who have served honorably and will call for your resignation. The ball is in your court. There are no excuses. You either served honorably or you did not.”

The San Gabriel Tribune is reporting that the reason for Miller's discharge was ulcers. Miller told the Tribune that the Army discharged him after discovering he had ulcers. He said, "They were never supposed to accept anyone with asthma or ulcers."

SGV Tribune has article on Rep. Gary Miller's military service; Gives reason for Discharge

The San Gabriel Tribune has an article about the military service of Rep. Gary Miller that includes the reason for his Honorable Discharge.

The article states that he had ulcers since he was 10 years old and was Discharged because of it. Miller said, "They were never supposed to accept anyone with asthma or ulcers."

Vote in our 42nd Congressional Primary Poll

Vote in our 42nd Congressional Republican primary poll. The question is, "Which candidate in the 42nd Congressional district has the best chance to defeat Rep. Gary Miller in the Republican primary?"

David Su, who has been in first place for more than two weeks, has fallen below 50% for the first time in two weeks. He has 48%. Lee McGroarty is second with 27%. Phil Liberatore is last with 24%.

Harper's Magazine Details Rep. Gary Miller's Military Service

Harper's Magazine has a story today about the military service of Rep. Gary Miller. According to the story he served in 1967 before being Honorably Discharged. It states his time was spent at boot camp.

The article tries to attack Miller because some web sites state that he served in 1967 and 1968.

A Miller spokeswoman said, "Congressman Miller volunteered to the U.S. Army and was Honorably Discharged due to medical reasons within a matter of months." She went on to say, "While we cannot control what other websites say about Congressman Miller’s military service, the official website for the House of Representatives states that Congressman Miller served in 1967." That web site can be seen here.

Memorial Day Statement from Lee McGroarty

A supporter of 42nd Congressional candidate Lee McGroarty suggested that we purposefully didn't post Lee McGroarty's Memorial Day message but did post messages from Rep. Gary Miller and David Su. Apparently they didn't read our blog yesterday which said that we were not posting stories or comments on Memorial Day. Miller and Su sent out their messages before Monday. McGroarty's website didn't post the message until 15:44 (3:44pm) on Memorial Day.

Also, the McGroarty campaign is the only campaign of the four Republicans in the 42nd primary that does not send us emails and releases. Unless we go to there web site, we don't see their "news."

Since an allegation was made we wanted to explain why there was a delay in posting this.

Memorial Day is a time to take stock of the present, reflect on the past, and renew our commitment to the future of America.

Today, as in the past, there are problems that must be solved and challenges that must be met. We can tackle them with our full strength and creativity only because we are free to work them out in our own way. We owe this freedom of choice and action to those men and women in uniform who have served this nation and its interests in time of need. In particular, we are forever indebted to those who have given their lives that we might be free.

I don't have to tell you how fragile this precious gift of freedom is. Every time we hear, watch, or read the news, we are reminded that liberty is a rare commodity in this world.

This Memorial Day of 1983, we honor those brave Americans who died in the service of their country. I think an ancient scholar put it well when he wrote: ``Let us now praise famous men . . . All these were honored in their generation, and were the glory of their times. Their bodies are buried in peace; but their name liveth for evermore.'' As a tribute to their sacrifice, let us renew our resolve to remain strong enough to deter aggression, wise enough to preserve and protect our freedom, and thoughtful enough to promote lasting peace throughout the world.

"48 Hour Notice" Donations in 42nd race

Starting May 20, any time a Congressional candidate receives a contribution (including "in-kind contributions") or a loan of $1,000 or more, they must file a "48 hour notice" with the FEC within 48 hours of receiving it.

Since May 20 only two candidates have filed "48 hour notices." Rep. Gary Miller has received three donations totaling $4,500. Phil Liberatore has received one donation of $1,000.

David Su sending out campaign mailer?

42nd Congressional candidate David Su wrote this on his Facebook page today, "Sending out mailers to the constituents of the 42nd CD. It's gonna be with a little personal touch added to it!"

If sending it district wide, Su would be the third candidate in the Republican primary to send out a campaign mail piece, joining Rep. Gary Miller and Phil Liberatore. Lee McGroarty would be the only candidate that has not sent out a district wide mail piece. There is still some time left to mail one, but not much.

During the War on Terror, nearly 5,500 men and women have made the ultimate sacrifice for us by defending our nation and ideals of life, liberty, and the pursuit of happiness. One of these fallen servicemembers includes Lance Cpl. Abraham “Abe” Simpson, a Chino resident and member of Calvary Chapel Chino Hills. Abe’s ultimate sacrifice has touched me personally and I will never forget him. Prior to joining the Marine Corps, I had the honor to present Abe an American flag that had been flown over the Capitol at his Eagle Scout award ceremony. In the beginning of his senior year of high school, Abe joined the Marines, something he had long wanted to do. Though just 19, Abe knew what he wanted, where he was going, and what his mission was while serving in Iraq. On November 9, 2004, Abe gave his life for his fellow Americans in the bloody battle of Fallujah.

Hello Everyone! It is Friday so happy Friday! I hope everyone here has great plans for Memorial Day weekend. Many Americans use this weekend or that extra day to go on vacation with family and friends to relax and unwind from weeks worth of intense labor. Some go to the beach, some go camping, and some go out of town. This is all great, but I hope people realize what the meaning of Memorial Day is, to remember those who have made the ultimate sacrifice for serving our country in uniform. These men and women made a decision of valor, making the sacrifices to delay their schooling, the pursue of their careers, and to be with their families to serve our country. I know everyone can't do this, it's more of a calling for those who are serving now, but let us not forget those who had served in the past. Those individuals did not have a choice, who answered the call to fight for freedom and to preserve the republic at all cost. Let us remember them, remember people like Retired Navy Lt. John Finn who recently passed away at age 100 and who was a recipient for the Medal of Honor, for his bravery and acts of valor during Pearl Harbor.

A look at the 42nd Republican Race

A look at the campaigns of the four Republican candidates with a week and a half to go.

Rep. Gary Miller: Has been sending out several mail pieces a week, for several weeks. About half have targeted Phil Liberatore. He has also had television and radio ads. Has put up a Phil Liberatore for Congress website and Lee McGroarty for Congress which list some of the baggage each candidate has.

Phil Liberatore: Appears to have the best chance of defeating Miller. He has spent close to $500,000. He regularly appears on local radio shows. He comments daily on his Facebook and Twitter pages. He has been running ads on television and radio. He has mailed several campaign pieces. One of them, claiming the endorsement of the Chairman of the Los Angeles County Republican Party, caused him some negative media attention.

Lee McGroarty: His campaign has become very quiet. According to his campaign website the last news release was May 17. He has not posted an event on his event page since he listed a May 8 event. I have yet to hear McGroarty on any radio talk show. He has never commented on his McGroarty for Congress Facebook page. He has not commented on his Twitter page since May 17. However, his campaign may be about to become more active. Any regular reader to our blog knows that for the last few weeks McGroarty supporters were commenting that Liberatore was under FEC investigation for sending out mail with his corporate logo. Since, only those that filed an FEC complaint can have knowledge of it, we commented that McGroarty, or one of his supporters, had filed a complaint. Yesterday we posted a story that a complaint regarding this issue was filed against Liberatore several weeks ago. McGroarty cannot win without defeating Miller AND Liberatore so this might be the beginning of an offensive against Liberatore. But there are less than two weeks to election day so if it happens, we will see it soon. As of the most recent FEC filings, McGroarty has the most cash on hand of the three challengers to Miller.

David Su: He has been flying under the radar and will probably surprise some people on election day with his vote total. He has appeared on the John and Ken show, as well as in several Asian newspapers. He has been walking door to door and put up campaign signs throughout the district. He also comments on his campaign facebook page daily.

Lee McGroarty files FEC Forms, files one day late

42nd Congressional Candidate Lee McGroarty has filed his pre-primary FEC forms one day late. The forms were due by 11:59pm May 27. The FEC is showing the forms were submitted on May 28.

He raised $5,917, loaned himself $1,700 and spent $356.10. He has $10,331.67 cash on hand.

McGroarty is challenging Rep. Gary Miller, Phil Liberatore and David Su in the Republican primary in the 42nd Congressional district.

McGroarty spent the least of the four Republican candidates during this reporting period, with less than two weeks until the election.

42nd FEC Filing Update

Yesterday at 11:59 pm (EST) was the deadline (12 days before primary) for 42nd Congressional candidates to file their pre-primary fundraising and spending forms.

Rep. Gary Miller raised $23,854.95 and spent $128,491.16. This leaves him with $948,141.16 cash on hand.

Phil Liberatore raised $27,166, loaned himself $375,000 and spent $398,410.99. He has $7,325.49 cash on hand.

David Su raised $1,422 and spent $1,327. He has $46.33 cash on hand.

The FEC web site is currently not showing they have received forms from Lee McGroarty. There is a fine for filing forms late and no extensions are granted.

FEC Complaint Filed against Phil Liberatore

We received an email from someone who said that they filed a Federal Election Commission (FEC) complaint against 42nd Congressional candidate Phil Liberatore on May 10. They included a confirmation letter from the FEC. The FEC has numbered the complaint MUR 6288.

The email explained the reason for the complaint. "I got my hands on one of his campaign solicitations that had IRS Problem Solvers in big, bold letters at the top and at the bottom it clearly stated that it was paid for by the Phil Liberatore for Congress campaign. A big legal no-no as I'm sure you're aware."

Judge's ruling means Jane Barnett, not Robert Vaughn, Chair of LA County Republican Party

Allen Wilson at RedCounty.com is reporting that a ruling today by a Los Angeles County Judge means Jane Barnett, not Robert Vaughn, is the Chair of the Los Angeles County Republican Party.

Recently we had posted several stories about the dispute after 42nd Congressional candidate Phil Liberatore sent out a mail piece stating that he had the endorsement of Robert Vaughn. His title was listed as Chairman of the LA County Republican Party. The SGV Tribune and Orange County Register both wrote stories about the mail piece.

Congressional Candidate Phil Liberatore has long pledged to be a different kind of Congressman than the one he seeks to replace in his race for the GOP nomination in California's 42nd district. He has said that he intends to fly coach to Washington DC and has promises to do a better job than six-term incumbent Gary Miller at communicating with voters in his district. In his race to replace Miller, Liberatore is giving voters a sense of how he would stay in touch with them if they send him to Washington. Launching a campaign called "Ask Phil," Liberatore has given out his cell phone number and invited potential constituents to contact him with questions related to the campaign and issues that are on their mind. Liberatore also blogs for two popular websites, BigGovernment.com and PoliticalMavens.com, sends regular udpates from his Twitter account, communicates to supporters through Facebook and posts regular video updates to his YouTube site. He's also publishing a book Inside The IRS, in June. Taken together, the various communication methods are in stark contrast to Miller who finally got around to creating a website in early May with just a month to go in the campaign. "What can I say, I'm Italian!" laughed Liberatore when asked about the various tools his campaign has been using to keep in touch with voters. "I love people and I love to tell them about this campaign and what I hope to do for them. Our campaign is trying to use every method of communication that modern technology offers us. Phil Liberatore Files Pre-Primary Fundraising totals; Spends nearly $400,000 since April 1

42nd Congressional candidate Phil Liberatore has filed his FEC forms for the period from April 1 to May 19. His totals show he is serious about trying to defeat Rep. Gary Miller.

He raised $27,166, loaned himself $375,000 and spent $398,410.99. He has $7,325.49 cash on hand.

Most of his expenses were related to advertising.

Liberatore's campaign has now spent more than $500,000 since January 1.

Liberatore is challenging Rep. Gary Miller, David Su and Lee McGroarty for the Republican nomination in the 42nd Congressional district.

David Su Files Pre-Primary Fundraising totals

42nd Congressional candidate David Su has filed his pre-primary FEC forms. From April 1 to May 19 he raised $1,422 and spent $1,327. He has $46.33 cash on hand for the two remaining weeks of the election.

Most of his expenses were related to yard signs and advertising.

For the primary Su has raised a total of 3,428.57 and spent $3,382.24.

Su is challenging Rep. Gary Miller, Phil Liberatore and Lee McGroarty for the Republican nomination in the 42nd Congressional district.

Phil Liberatore responds to his picture in Rep. Gary Miller mail piece, not content

For a few weeks now mail pieces from Rep. Gary Miller and 42nd Challenger Phil Liberatore have been flying back and forth. I haven't been posting them because all of the information can be found on their web sites and there have been a lot of pieces. However, this time I have decided to talk about one.

Rep. Gary Miller sent out a piece in which he mentions several lawsuits Phil Liberatore has been involved in. All of them are on the anti-Liberatore Miller put up, Phil Liberatore for Congress, so I linked to them.

First, he mentions Liberatore was sued by the U.S. Department of Labor for not paying his employees overtime. Second, Miller mentions Liberatore sued his own employee for over a million dollars for taking a side job. Finally, Miller mentioned that Liberatore sued a roofing company because the tar smelled. Miller also lists all of the lawsuits Liberatore has been involved in by case number.

The two pictures on the front of the mail piece are from the youtube video of Liberatore boxing for his 55th Birthday. We posted about that video in March.

Liberatore has responded to the mail piece on his facebook page.

"You may received a mailer with me on the cover sent by my opponent Gary Miller. I think he used it trying to embarrassing me but why? I set a goal of getting in shape and sparring five rounds with my boxing trainer. I am very proud to say I accomplished this goal and before we started sparring I did 55 push ups. It wa...s a great birthday party with wife, friends and co-workers there for the main event. As I walk the district people tell me we need to send a fighter to Washington not another incumbent politician. Take a look at the video and tell me what you think! I have not noticed Liberatore or Miller commenting on any specific mail piece in the past. So it is interesting that Liberatore would comment on this one. What is more interesting to me is that he didn't respond to being sued by the U.S. Department of Labor, suing his own employee for taking a side job or suing a roofing company because the tar smelled. He only responded to the boxing pictures of him being used.

OC Register has story on Phil Liberatore endorsement by Robert Vaughn

Last week we posted that Jane Barnett, Chair of the Los Angeles County Republican Party, had sent 42nd Congressional candidate Phil Liberatore a letter asking that he stop claiming he has been endorsed by the Chairman of the Los Angeles County Republican Party.

Today the OC Register posted a story on their blog, Total Buzz.

The Total Buzz mentions that Robert Vaughn, who has endorsed Liberatore and claims to be the LA County Republican Party Chairman, lists on his campaign site that he is a former Navy Admiral. We mentioned that he was a former Admiral in one of our posts. It turns out that he is not a former Admiral. The Total Buzz reports that, "He said the website was wrong; that he didn’t know how that line appeared that and said he would get it fixed." It now says he is a "former aviation technician.”

Updated: Vote in our 42nd Republican Primary Poll

Vote in our 42nd Republican primary poll located to the left. The question is, "Which candidate in the 42nd Congressional district has the best chance to defeat Rep. Gary Miller in the Republican primary?"

Updated: Currently (11:20 am) David Su leads with 58%, Lee McGroarty is second with 25% and Phil Liberatore rounds out the field with 16%.

Su is doing a good job getting his supporters to vote as his vote percentage has been consistent since we posted the poll.
