The Miller Military Records: McGroarty played it right, Liberatore played it wrong
Lee McGroarty waited until after a local newspaper story was posted to issue a press release. McGroarty was able to know the medical reason for the discharge and have the knowledge of more comments from Miller. McGroarty was able to look more thoughtful and not appear to be doing it for political expediency.
Liberatore, on the other hand, looks very political in his actions. So much so, that McGroarty said that Liberatore was "grandstanding." He also looks like he was so quick to put something out, hoping that the media would give him attention, that he has errors in his release.
First, Liberatore's release states, "according to the Harper’s article, Miller was discharged after just 49 days of enlistment in 1967." Problem is that the article doesn't say that.
The article states, "According to his military record, he spent about seven weeks in boot camp at Fort Ord, California between early-September and late-October 1967, at which point he was discharged."
Now Rep. Gary Miller has released his records so we can see how many days he served. According to Miller's Military Service Certificate, and a look at a 1967 calendar, he served 54 days.
So where did Phil Liberatore get 49 days from? Did Liberatore really put out a press release that distorts Miller's military service, while accusing Miller of doing the same thing?

Rep. Gary Miller releases Military Record showing Honorable Discharge
The document states that he served from September 7, 1967 to October 30, 1967. It states that "Service was terminated by Honorable Discharge."
The site also commented on his military service.
"A lot of fuss has been made about Gary’s military service by the guys running against him—and they’ve made up a lot of lies and fed them to the press. Here are the facts: Gary enlisted in 1967—when he was 18 years old. While in boot camp, Army doctors learned he had a childhood ulcer, which made him ineligible to serve so therefore he received an honorable discharge. To learn more, download Gary’s Certificate of Military Service. Gary has never used his brief time in the Army for political gain."
Lee McGroarty defends Rep. Gary Miller; says Phil Liberatore "grandstanding"
42nd Congressional candidate, and Veteran, Lee McGroarty has now commented on the matter. A press release issued by the McGroarty campaign says,
"The Vietnam War era was a difficult time in our country. Many future politicians avoided military service during the late 1960's and early 70's but Congressman Miller did not. Miller voluntarily enlisted in the U.S. Army to serve our country. As an enlisted veteran who served his country honorably, Lee McGroarty commends Mr. Miller and his call to duty."
McGroarty went on to say,
"As a veteran, I am very protective of questioning any American who voluntarily serves our country. I am willing to defend Congressman Miller and his record if he was discharged due to a medical reason. The greatest honor bestowed upon an American is to serve his or her country honorably. However, it is the deepest betrayal to misrepresent his or her service. I have the utmost confidence that Congressman Miller will come clean on his record."
The release goes on to say,
"One of my opponents, who never served our country, is calling out Miller for his military service and is “grandstanding” on an issue he knows nothing about. I want to make one point very clear, this is a very uncomfortable issue for me and my campaign. I want to win on the real issues -- jobs and spending where I believe Miller is vulnerable. I am asking Miller to come clean on his military record. It is not a question of “if he served” but whether he served honorably. Congressman Miller, show us your DD 214 so this whole matter can be put to bed quickly and we can get back to the business of explaining our positions on the economy, etc. If you don’t, then I will defend the men and women who have served honorably and will call for your resignation. The ball is in your court. There are no excuses. You either served honorably or you did not.”
The San Gabriel Tribune is reporting that the reason for Miller's discharge was ulcers. Miller told the Tribune that the Army discharged him after discovering he had ulcers. He said, "They were never supposed to accept anyone with asthma or ulcers."
The entire McGroarty press release is below.

Decorated Military Leaders Question Gary Miller's Military Service; Issue Call For Honesty
Decorated Military Leaders Announce Support for Congressional Candidate Phil Liberatore; Call for Release of Gary Miller's Military Records After Harper’s Magazine Charges Congressman With Misrepresenting Military Record.
Whittier, CA (PRWEB) -- In the wake of accusations in Harper’s Magazine Online that Congressman Gary Miller misrepresented his military service during the Vietnam era, three respected military veterans, Major General Paul Vallely, Colonel John Fer, a Prisoner of War during Vietnam and former top level White House Military Officer, Lt. Colonel Robert "Buzz" Patterson have issued a call for Miller to release his military medical and service records. The three veterans form the Military and Veterans Affairs Advisory Committee to advise Miller's opponent for the GOP nomination in California's 42nd district, Phil Liberatore.

Harper's Magazine Details Rep. Gary Miller's Military Service
The article tries to attack Miller because some web sites state that he served in 1967 and 1968.
A Miller spokeswoman said, "Congressman Miller volunteered to the U.S. Army and was Honorably Discharged due to medical reasons within a matter of months." She went on to say, "While we cannot control what other websites say about Congressman Miller’s military service, the official website for the House of Representatives states that Congressman Miller served in 1967." That web site can be seen here.

Also, the McGroarty campaign is the only campaign of the four Republicans in the 42nd primary that does not send us emails and releases. Unless we go to there web site, we don't see their "news."
Since an allegation was made we wanted to explain why there was a delay in posting this.

President Ronald Reagan 1983 Memorial Day Message
####
Message on the Observance of Memorial Day
May 26, 1983
Memorial Day is a time to take stock of the present, reflect on the past, and renew our commitment to the future of America.
Today, as in the past, there are problems that must be solved and challenges that must be met. We can tackle them with our full strength and creativity only because we are free to work them out in our own way. We owe this freedom of choice and action to those men and women in uniform who have served this nation and its interests in time of need. In particular, we are forever indebted to those who have given their lives that we might be free.
I don't have to tell you how fragile this precious gift of freedom is. Every time we hear, watch, or read the news, we are reminded that liberty is a rare commodity in this world.
This Memorial Day of 1983, we honor those brave Americans who died in the service of their country. I think an ancient scholar put it well when he wrote: ``Let us now praise famous men . . . All these were honored in their generation, and were the glory of their times. Their bodies are buried in peace; but their name liveth for evermore.'' As a tribute to their sacrifice, let us renew our resolve to remain strong enough to deter aggression, wise enough to preserve and protect our freedom, and thoughtful enough to promote lasting peace throughout the world.
Ronald Reagan

If sending it district wide, Su would be the third candidate in the Republican primary to send out a campaign mail piece, joining Rep. Gary Miller and Phil Liberatore. Our nation owes an incredible debt of gratitude that can never fully be repaid to all the brave men and women who have served our nation by helping to promote peace, stability, and democracy worldwide. Day in and day out, in the streets of Baghdad, in the countryside of Afghanistan, and in hotspots around the globe, American servicemembers serve our country faithfully and honorably.
During the War on Terror, nearly 5,500 men and women have made the ultimate sacrifice for us by defending our nation and ideals of life, liberty, and the pursuit of happiness. One of these fallen servicemembers includes Lance Cpl. Abraham “Abe” Simpson, a Chino resident and member of Calvary Chapel Chino Hills. Abe’s ultimate sacrifice has touched me personally and I will never forget him. Prior to joining the Marine Corps, I had the honor to present Abe an American flag that had been flown over the Capitol at his Eagle Scout award ceremony. In the beginning of his senior year of high school, Abe joined the Marines, something he had long wanted to do. Though just 19, Abe knew what he wanted, where he was going, and what his mission was while serving in Iraq. On November 9, 2004, Abe gave his life for his fellow Americans in the bloody battle of Fallujah.

Memorial Day Statement from David Su
####
Hello Everyone! It is Friday so happy Friday! I hope everyone here has great plans for Memorial Day weekend. Many Americans use this weekend or that extra day to go on vacation with family and friends to relax and unwind from weeks worth of intense labor. Some go to the beach, some go camping, and some go out of town. This is all great, but I hope people realize what the meaning of Memorial Day is, to remember those who have made the ultimate sacrifice for serving our country in uniform. These men and women made a decision of valor, making the sacrifices to delay their schooling, the pursue of their careers, and to be with their families to serve our country. I know everyone can't do this, it's more of a calling for those who are serving now, but let us not forget those who had served in the past. Those individuals did not have a choice, who answered the call to fight for freedom and to preserve the republic at all cost. Let us remember them, remember people like Retired Navy Lt. John Finn who recently passed away at age 100 and who was a recipient for the Medal of Honor, for his bravery and acts of valor during Pearl Harbor.

A look at the 42nd Republican Race
A look at the campaigns of the four Republican candidates with a week and a half to go.
Rep. Gary Miller: Has been sending out several mail pieces a week, for several weeks. About half have targeted Phil Liberatore. He has also had television and radio ads. Has put up a Phil Liberatore for Congress website and Lee McGroarty for Congress which list some of the baggage each candidate has.
Phil Liberatore: Appears to have the best chance of defeating Miller. He has spent close to $500,000. He regularly appears on local radio shows. He comments daily on his Facebook and Twitter pages. He has been running ads on television and radio. He has mailed several campaign pieces. One of them, claiming the endorsement of the Chairman of the Los Angeles County Republican Party, caused him some negative media attention.
Lee McGroarty: His campaign has become very quiet. According to his campaign website the last news release was May 17. He has not posted an event on his event page since he listed a May 8 event. I have yet to hear McGroarty on any radio talk show. He has never commented on his McGroarty for Congress Facebook page. He has not commented on his Twitter page since May 17. However, his campaign may be about to become more active. Any regular reader to our blog knows that for the last few weeks McGroarty supporters were commenting that Liberatore was under FEC investigation for sending out mail with his corporate logo. Since, only those that filed an FEC complaint can have knowledge of it, we commented that McGroarty, or one of his supporters, had filed a complaint. Yesterday we posted a story that a complaint regarding this issue was filed against Liberatore several weeks ago. McGroarty cannot win without defeating Miller AND Liberatore so this might be the beginning of an offensive against Liberatore. But there are less than two weeks to election day so if it happens, we will see it soon. As of the most recent FEC filings, McGroarty has the most cash on hand of the three challengers to Miller.
David Su: He has been flying under the radar and will probably surprise some people on election day with his vote total. He has appeared on the John and Ken show, as well as in several Asian newspapers. He has been walking door to door and put up campaign signs throughout the district. He also comments on his campaign facebook page daily.
Lee McGroarty files FEC Forms, files one day late
He raised $5,917, loaned himself $1,700 and spent $356.10. He has $10,331.67 cash on hand.
McGroarty is challenging Rep. Gary Miller, Phil Liberatore and David Su in the Republican primary in the 42nd Congressional district.
McGroarty spent the least of the four Republican candidates during this reporting period, with less than two weeks until the election.
42nd FEC Filing Update
Rep. Gary Miller raised $23,854.95 and spent $128,491.16. This leaves him with $948,141.16 cash on hand.
Phil Liberatore raised $27,166, loaned himself $375,000 and spent $398,410.99. He has $7,325.49 cash on hand.
David Su raised $1,422 and spent $1,327. He has $46.33 cash on hand.
The FEC web site is currently not showing they have received forms from Lee McGroarty. There is a fine for filing forms late and no extensions are granted.

FEC Complaint Filed against Phil Liberatore

Judge's ruling means Jane Barnett, not Robert Vaughn, Chair of LA County Republican Party
Recently we had posted several stories about the dispute after 42nd Congressional candidate Phil Liberatore sent out a mail piece stating that he had the endorsement of Robert Vaughn. His title was listed as Chairman of the LA County Republican Party. The SGV Tribune and Orange County Register both wrote stories about the mail piece.
The Orange County Register's Total Buzz blog has a picture of the mail piece.
If Liberatore comments on the issue I will post his response.

Congressional Candidate Phil Liberatore has long pledged to be a different kind of Congressman than the one he seeks to replace in his race for the GOP nomination in California's 42nd district. He has said that he intends to fly coach to Washington DC and has promises to do a better job than six-term incumbent Gary Miller at communicating with voters in his district. In his race to replace Miller, Liberatore is giving voters a sense of how he would stay in touch with them if they send him to Washington. Launching a campaign called "Ask Phil," Liberatore has given out his cell phone number and invited potential constituents to contact him with questions related to the campaign and issues that are on their mind. Voters in the 42nd district may reach Phil at: (714) 795-1601. Liberatore also blogs for two popular websites, BigGovernment.com and PoliticalMavens.com, sends regular udpates from his Twitter account, communicates to supporters through Facebook and posts regular video updates to his YouTube site. He's also publishing a book Inside The IRS, in June. Taken together, the various communication methods are in stark contrast to Miller who finally got around to creating a website in early May with just a month to go in the campaign. "What can I say, I'm Italian!" laughed Liberatore when asked about the various tools his campaign has been using to keep in touch with voters. "I love people and I love to tell them about this campaign and what I hope to do for them. Our campaign is trying to use every method of communication that modern technology offers us. But the goal remains the same: To listen to voters and communicate with them my ideas and how I plan to help make their lives better by lifting the burden of taxes off of their families." A trusted businessman, and resident of the 42nd District for over 26 years, Liberatore has a passion for helping people. He is running against six-term incumbent Republican congressman Gary Miller in a district which stretches from Whittier in Los Angeles County to Mission Viejo in Orange County and includes parts of San Bernardino County, is one of the most conservative districts in California with a track record of electing conservative candidates. Liberatore has his Bachelor of Science degree in Accounting and his Master of Business Administration degree in Finance from the University of Southern California. Phil Liberatore responds to his picture in Rep. Gary Miller mail piece, not content
Rep. Gary Miller sent out a piece in which he mentions several lawsuits Phil Liberatore has been involved in. All of them are on the anti-Liberatore Miller put up, Phil Liberatore for Congress, so I linked to them.
First, he mentions Liberatore was sued by the U.S. Department of Labor for not paying his employees overtime. Second, Miller mentions Liberatore sued his own employee for over a million dollars for taking a side job. Finally, Miller mentioned that Liberatore sued a roofing company because the tar smelled. Miller also lists all of the lawsuits Liberatore has been involved in by case number.
The two pictures on the front of the mail piece are from the youtube video of Liberatore boxing for his 55th Birthday. We posted about that video in March.
Liberatore has responded to the mail piece on his facebook page.
"You may received a mailer with me on the cover sent by my opponent Gary Miller. I think he used it trying to embarrassing me but why? I set a goal of getting in shape and sparring five rounds with my boxing trainer. I am very proud to say I accomplished this goal and before we started sparring I did 55 push ups. It wa...s a great birthday party with wife, friends and co-workers there for the main event. As I walk the district people tell me we need to send a fighter to Washington not another incumbent politician. Take a look at the video and tell me what you think! You can post a message about it to my Campaign Facebook page."
I have not noticed Liberatore or Miller commenting on any specific mail piece in the past. So it is interesting that Liberatore would comment on this one. What is more interesting to me is that he didn't respond to being sued by the U.S. Department of Labor, suing his own employee for taking a side job or suing a roofing company because the tar smelled. He only responded to the boxing pictures of him being used.
OC Register has story on Phil Liberatore endorsement by Robert Vaughn
Today the OC Register posted a story on their blog, Total Buzz.
The Total Buzz mentions that Robert Vaughn, who has endorsed Liberatore and claims to be the LA County Republican Party Chairman, lists on his campaign site that he is a former Navy Admiral. We mentioned that he was a former Admiral in one of our posts. It turns out that he is not a former Admiral. The Total Buzz reports that, "He said the website was wrong; that he didn’t know how that line appeared that and said he would get it fixed." It now says he is a "former aviation technician.”
Updated: Vote in our 42nd Republican Primary Poll

Whittier Daily News has story on 42nd Race; Miller explains "Tax Fraud" signs
A large part of the article was spent on the "Don't Elect Tax Fraud Phil Liberatore" signs. I found Miller's explanation for why he put them up interesting. He told the Whittier Daily News,
"After a while you get tired of being poked by somebody," Miller said, explaining his negative campaigning. "Enough is enough ... you get tired of being bashed."
So Miller put up the signs because he felt Liberatore was bashing him? Interesting.
The article stated the "signs are based on allegations the candidate's clients have sued him for preparing fraudulent tax returns." The paper wrote, "Liberatore responds that he has never been accused of tax fraud by the IRS."
The paper spoke with two experts, Jack Pitney and Allen Hoffenblum, about the 42nd race (and Rep. Dreier's race). Pitney said it would be a "shocking development," for Miller (or Dreier) to lose. Hoffenblum said,"None of (the challengers) is going to have the money to significantly challenge these incumbents. The majority of voters won't even know who the challengers are." He went on to say, "If they vote for someone other than the incumbent, it shows dissatisfaction with the incumbent, not support for the challenger."
Lee McGroarty and David Su were also interviewed for this article. To read more please visit the Whittier Daily News.

SGV Tribune Covers Phil Liberatore Endorsement Mailer; So does Red County
Now the San Gabriel Tribune has published a story on it.
CHAIRMAN WHO?: The Los Angeles County Republican Party has not taken too kindly to a mailing sent out by GOP congressional candidate Phil Liberatore. Or has it?
Liberatore, who is hoping to oust fellow Republican Gary Miller from his congressional seat, sent out a campaign mailing that boasts the support of Robert Vaughn, who Liberatore cites on the mailing as chairman of the Los Angeles County Republican Party.
But Jane Barnett, who also boasts the title of Los Angeles County Republican Party Chairwoman, sent a letter to Liberatore on Friday telling him that Vaughn "is not and has never been chairman" of the party and "the Los Angeles County Republican Party does not endorse Phil Liberatore for Congress."
Turns out, there is a lawsuit between Barnett and Vaughn over who is the rightful chairman.
Allen Wilson at Red County, who is a Member of the LA County Republican Central Committee, also has a story about it. His point is that Chairman of Central Committee's are barred from endorsements. So Vaughn, if he was Chairman, would be barred from endorsing Liberatore.
More on Robert Vaughn
According to the letter Liberatore had been sending out "mailings to voters attempting to intentionally mislead them that you are endorsed by the Chairman of the Los Angeles County Republican Party."
The letter went on to say ,"Robert Vaughn IS NOT AND HAS NEVER BEEN Chairman of the Los Angeles County Republican Party."
I have since found out that Robert Vaughn is running for Congress in the 38th district against Rep. Grace Napolitano. His site says that he is a former Navy Admiral.
His website says, "A native Californian, Robert Vaughn was born in 1959 at the U.S. Naval Hospital in San Diego. Raised and educated in Los Angeles County, the former Navy Admiral proudly served from 1979 through 1983, under his Commander-in-Chief Ronald Reagan. Vaughn held high level top-secret clearance, was involved with squadron operations, and was responsible for tracking Russian nuclear submarines operating in the Pacific Ocean, with great attention to the entire west coast of the United States."
He is currently a counselor. He presently holds an AA degree and holds a certificate in addictions counseling.
Vaughn never claims to be Chairman but says, "In December 2008, he was elected Second Vice Chairman to its executive board. Shortly thereafter in 2009, Vaughn ascended to the position of Chairman following the resignations of the previous Chairman and First Vice Chairman. Today he humbly assumes all responsibilities of chairmanship as he serves all Republican voters and their families in fostering the values and principles of their party."
Is Phil Liberatore misleading voters again?
The candidate he was referring to is Phil Liberatore. We asked our readers if Liberatore was being misleading voters when he put out a press release touting, "Congressional Candidate Phil Liberatore Praised by Calvary Chapel Founder Pastor Chuck Smith." Currently 85% do.
Now Rep. Gary Miller's campaign site has a letter from Jane Barnett, the Chair of the Los Angeles County Republican party to Phil Liberatore. It states (Copied Caps just as in letter),

Calvary Chapel Founder Chuck Smith Says He Did Not Endorse Phil Liberatore
The letter states,
"It has come to my attention that recently it has been stated that I have endorsed a candidate for the upcoming GOP nomination for the 42nd Congressional district. This is not the case, while I have expressed my admiration for Christians who desire to enter into Public Service, it is not my intent to endorse any particular candidate."
Yesterday we posted a story asking if Liberatore was being misleading about his support from Chuck Smith when he put out a press release titled, "Congressional Candidate Phil Liberatore Praised by Calvary Chapel Founder Pastor Chuck Smith."
Miller's site, under the title,"CAUGHT: Liberatore Not Really Endorsed by Religious Leader," said,
"Phil Liberatore, the guy running against Congressman Miller, has been implying in his campaign literature and sparsely attended events that the founding pastor of Calvary Chapel has endorsed his campaign. This is not true.
Several of Gary’s supporters have contacted Pastor Chuck Smith for clarification. Today, Pastor Smith released the following statement:
“It has come to my attention that recently it has been stated that I have endorsed a candidate for the upcoming GOP nomination for the 42nd Congressional District. This is not the case, while I have expressed my admiration for Christians who desire to enter into Public Service, it is not my intent to endorse any particular candidate.”
Congressman Miller is a longtime member of Calvary Chapel Golden Springs and has the support of all the major pro-life and pro-family organizations."
The Liberatore press release never used the word "endorse," but the comment from Miller states Liberatore, "has been implying in his campaign literature and sparsely attended events that the founding pastor of Calvary Chapel has endorsed his campaign." So there is obviously more to the story than just the press release.
Plus, with Chuck Smith putting out a letter this story will get more attention.

Korean American, David Su Makes History
David Su, 909-202-2311
davidsuforcongress@gmail.com
www.younggungop.com
LOS ANGELES, May 8th, 2010
David Su is Korean American. At 26 years old, he may be one the youngest minority to ever run for Congress under the GOP banner. David was born in Young San, a US Army base in South Korea where his father was stationed. David came to America when he was a few months old and was raised by his grandparents while both his parents worked to support the family. Here, his grandfather reminded him of why Korea went to war, sharing their homeland's testimony that bigger government is never the solution and that liberty is an absolute right for every individual. David believes it is time for new leadership, to end Congressional corruption, stay true to conservative principles, and listen to the American people.

Lee McGroarty Responds to Miller Email; Changes story on why Business entity's were suspended
McGroarty has now commented on the email, which you can find below.
When McGroarty originally responded his web site said,
"McGroarty's personal accountant, Ron Uehle, responded with the following statement: "Lee, I just spoke with the Franchise Tax Board and have cleared up the matter of your corporations being "suspended". The Franchise Tax Board failed to forward to the Secretary of State's office the paperwork that was filed in 2008 on your behalf. It will take 10 business days for the Secretatary of State's website to be updated to show the "active" status of your corporations."
The McGroarty campaign originally said that the problem started in 2008 when "The Franchise Tax Board failed to forward to the Secretary of State's office the paperwork that was filed in 2008," but Miller's email and documentation on Lee McGroarty for Congress stated his corporations were suspended in 2007. Now the McGroarty campaign says the problem started in 2006/2007 and say that the problem is because,
"a Statement of Information Form and a $25 filing fee were not filed properly by my accountant. My accountant corrected the error in 2008 but the Secretary of State did not update its records. The Franchise Tax Board has assured us that this was an oversight and the error is being resolved. 401(k) Administrators, Inc. had not filed a tax return for the past few years as the corporation was dissolved. However, the State is not showing receipt of the one-page form for dissolving that corporation and my accountant is working to resolve this technical error."
Now to the release,

McGroarty Blasts Miller's Fraud Allegations
Congressman Miller recently sent out an extremely deceptive and misleading mass email claiming that I have been operating my businesses without proper licensure and have been "handling retirement funds without a license." In the process, Congressman Miller has smeared my business, my clients and my family as we have worked extremely hard to build a solid reputation in the community and in the financial services industry.

Is Phil Liberatore being misleading about Chuck Smith's Support?
The release started by saying,
"Pastor Chuck Smith, founder of the Calvary Chapel in Costa Mesa, CA is publicly expressing his admiration for Congressional candidate Phil Liberatore in his race for the GOP nomination in the 42nd district."
"Unless righteous men stand for public office our country will surely crumble," said Smith. "I have known Phil for a number of years and have great respect for him. He loves God, his family and his country and right now our nation needs men like Phil who will stand in the gap. I'm glad he's answering the call to service"
Later the release said, "I'm honored to receive such kind words from a great man like Pastor Chuck Smith," noted Liberatore. "Calvary Chapel has blessed the nation and Southern California with the wonderful work they've done these last four decades. I'm honored but also humbled by his gracious words."

OC Register 42nd Congressional Republican Primary Race Story
Rep. Gary Miller on Fox News Today
This is what he wrote,
"On Wednesday, the Los Angeles City Council voted 13-1 to ban official travel to Arizona and block future contracts with companies there in protest of its new immigration law. Congressman Miller believes this boycott is an insult to American citizens and legal immigrants. The boycott could crush important industries that are helping America’s economy recover. More specifically, this shortsighted move could stop airline contracts at LAX, cancel over $25 million in Clean Truck Program contracts, and cancel important forensics and law enforcement tools. Ultimately, the boycott undermines the rule of law and will further communicate to illegal immigrants that they can come live, work, and soak up taxpayer-funded resources in California. Because the federal government has failed to address illegal immigration and border security problems, Congressman Miller believes firmly the state of Arizona has a duty to protect its citizens from these ongoing and escalating issues. Today, he will appear on Fox News with Neil Cavuto at 1:00pm PST to discuss this issue."
Anti Lee McGroarty Email sent out
Last night I received a new email. This one was entitled, "Challenger Operates Businesses With Suspended Licenses." It links to Lee McGroarty for Congress, which lists several reasons why one shouldn't vote for McGroarty.
I left the links that were in the email.
####
In 2007, the California Secretary of State and California Franchise Tax Board suspended the business licenses of both companies - "Retire America Corporation" and "401(K) Administrators Inc." that Congressional candidate Lee McGroarty owns and operates.
McGroarty’s business licenses were suspended for either "failure to pay one or more tax returns" or "failure to pay the business balances due."
For over 3 years, Lee McGroarty has been operating these businesses and handling client’s retirement funds without a license.
In these economic times, would you trust your retirement funds to an un-licensed company?
At a time when Congress is cracking down on financial fraud, this is the kind of activity they are looking to curtail. Why put this wolf in the henhouse?
On June 8, don’t reward law breakers by sending them to Congress.

An interview with Phil Liberatore Part 4 of 4
We posted his comments just as we received them.
Liberatore is challenging Rep. Gary Miller, Lee McGroarty and David Su for the Republican nomination in the 42nd Congressional district.
TCP: Why do you believe that you will do a better job than the 42nd's current Congressman, Gary Miller?
How much space do we have on this blog? The primary reason I believe I will do a better job than Gary is that I am a true conservative not just in name. I would not vote for Wall Street bailouts and voting with Barney Frank to put the taxpayers on the hook for an additional $300 billion dollars during the housing meltdown. I am sure Gary can have spin to these ten different ways but they don’t represent the fiscally conservative values I believe in.
I’m a fighter. For too long we have been playing defense against Democrats and RINOs but the time has come to go on the offense. There is going to be a large class of new Congressmen who will be voted into office to bring responsibility back to Washington. They will be scrutinized by their local voters like never before and I believe this mid-term election will be a new day in Washington.
The second reason is that I will show up to work. Gary currently has the 14th worst voting record in Congress. At the end of 2008 and beginning of 2009 he missed 64% of the votes. This was one of the most crucial times in our nations history and he did not show up for work.
TCP: How do you believe you are different from the other two Republican challengers, David Su and Lee McGroarty?

TCP: What is your position on the recently passed Health Care Reform bill?
This is one of the worst bills passed in the history of the United States. We need to fight to remove, defund and kill it at every turn. There are some very positive steps which could have been taken in health care including tort reform and interstate competition but the President ignored these for a radical agenda.

Daily Bulletin Publishes Former Assistant Secretary Cabrera's Defense of Rep. Gary Miller
Rep. Miller had this statement on his campaign site last week. We highlighted some of letter in our post last Friday.
"Don't Elect Tax Fraud Phil Liberatore" email sent out
Overnight I received the following email in my PERSONAL email, not the blog email. Which makes me wonder who else received it.
It talks about one of the lawsuits 42nd Congressional candidate Phil Liberatore was involved in and has links to the philliberatoreforcongress.com web site that Rep. Gary Miller put up.
####
DON'T ELECT TAX FRAUD PHIL LIBERATORE
You've Seen The Signs.
Now Read The Lawsuits.
Consider the facts:
Phil Liberatore champions himself as being able to solve your IRS tax problems.
His own staff sues him for making them "insert fraudulent and misleading information onto clients tax returns."
Phil Liberatore "settles" the lawsuit with his staff.
The Superior Court retains jurisdiction over the settlement to ensure the Liberatore follows through.
If your accountant, "took it upon himself to insert fraudulent information and otherwise revise, alter or modify proper tax returns... in order to submit said documents to the IRS and State of California" would you consider that "tax fraud?"
Likewise, if your accountant was accused of this type of illegal activity, would he/she "settle" the case or aggressively fight to clear his/her name? Considering Phil Liberatore has been involved in over 75 lawsuits, we'd expect him to fight to clear his name... He didn't. Why?
Don't elect Tax Fraud Phil to Congress.
####
Lee McGroarty also gets Negative Site
Well, we have now found the negative Lee McGroarty for Congress site. Unlike the Liberatore site which only addressed his law suits, the Lee McGroarty site raises several issues about McGroarty.
They include,
"Did you know over the last 28 elections Lee McGroarty has not voted in 20 of them! "
"Did you know that Lee McGroarty made up false endorsements for his campaign?" (We raised that issue last year.)
"Did you know that Lee McGroarty had both of his business licenses SUSPENDED by the Franchise Tax Board of the State of California?" (We reported that last week)
"And did you know that Lee McGroarty is being investigated for 7 federal campaign finance violations by the Federal Election Commission (FEC)?" (We reported that last week)

Rep. Gary Miller puts up Phil Liberatore site; Liberatore sued by U.S. Department of Labor for not paying overtime to employees
Yesterday we posted that "Don't elect Tax Fraud Phil Liberatore" signs had gone up. Liberatore responded by calling the allegations, that were not specific, "completely false."
I think this website is the Miller response and I wonder if Liberatore now regrets his "completely false" comment.
The site starts by stating, "Did you know that Phil Liberatore has been involved in more than 75 lawsuits in just Los Angeles and Orange Counties? Did you know he has been sued by employees, clients, friends, business associates, and the Bush Administration’s U.S. Department of Labor?"
It lists several cases including the following. I tried to link to the pdf related to each case.

An interview with Phil Liberatore Part 1 of 4; New Comments on "Tax Fraud" signs
We posted his comments just as we received it.
Liberatore is challenging Rep. Gary Miller, Lee McGroarty and David Su for the Republican nomination in the 42nd Congressional district.
Response to Gary Miller signs
Phil Liberatore: Incumbent Gary Miller recently placed signs around the district attacking me as “Tax Fraud” Phil. The charges are absolutely false and unfounded. I have never been under investigation, charged or convicted for tax fraud. I am a CPA with thousands of clients and not one person who I have prepared their tax return has ever been charged or convicted of tax fraud. What this tells me is that our campaign of talking about the issues and is resonating with people. From the voters I talk to Gary should be scared, as they are upset about the bailouts and lack of fiscal responsibility. I have fielded dozens of emails and calls today from people giving me their support from Gary’s campaign putting up the signs.
There is no truth to the charge of tax fraud it is just Gary Miller slinging mud.

Phil Liberatore Responds to "Tax Fraud" Signs
One thing I find interesting is that he calls the allegations "completely false," but never states what the allegations are. I doubt someone would put signs up like that without having proof of some kind. I guess we will have to wait and see. I am sure it will come out tomorrow since Liberatore has a press conference scheduled.

Rep. Gary Miller's Reponse #2
May 7, 2010—Congressman Gary Miller’s primary opponent has accused Gary of helping two nonprofit groups in exchange for campaign contributions from one of the nonprofit’s volunteer, nonpaid board members. These accusations are untrue.
The nonprofit groups, National CORE and Hope Through Housing, use public grants and private donations to redevelop at-risk neighborhoods and provide residents free or low cost senior health and childhood services. Their work beautifies neighborhoods, reduces crime and offers needed services to residents.

####
Before being elected to the California legislature more than 16 years ago and Congress more than 12 years ago, Gary Miller was a small business owner who built new homes and invested in real estate. Today, as part of Mr. Miller investment portfolio he still owns tracks of land, mostly in Southern California and Oregon.
Every year, Mr. Miller fully discloses his total investment portfolio to the U.S. House of Representatives ethics committee—included in this report are all of his land holdings.
There are hundreds of congressional watchdog groups in Washington, DC that were set up after federal law prohibited the use of “soft money” in federal campaigns. Soft money is a campaign contribution that can be in any amount and the donor doesn’t have to disclose his or her name. (For the record, Mr. Miller has never accepted these kinds of contributions.)
